General terms and conditions
I. SUBJECT
Art. 1. The present General Terms and Conditions are intended to regulate the relations between „ANBEL COMMERCE“ Ltd. hereinafter referred to as „ANBEL COMMERCE” and the customers who use the „ELECTRONIC SHOP” and/or wish to conclude a distance contract, hereinafter referred to as „USERS”, on the electronic shop located at the electronic address https://aestheticalbulgaria.com and e-mail office@aestheticalbulgaria.com, hereinafter referred to as „ELECTRONIC SHOP”. In particular, this document regulates the relationship in relation to the procedure for the conclusion, modification and termination of contracts under the terms and conditions of Chapter IV, Section I „Off-premises and Distance Contract” of the CPA through the "ELECTRONIC SHOP" of ANBEL COMMERCE, as well as the conditions for the use of the "ELECTRONIC SHOP" of ANBEL COMMERCE.

III. GENERAL TERMS AND CONDITIONS AND CHARACTERISTICS OF THE ELECTRONIC STORE
Art. 3. For the avoidance of doubt, the ANBEL COMMERCE e-shop, located at https://aestheticalbulgaria.com, is administered by ANBEL COMMERCE Ltd.
The e-store https://aestheticalbulgaria.com serves as a virtual platform for offering and selling goods and services.
The USER agrees to these terms and conditions of ANBEL COMMERCE, accepting them unconditionally and undertakes to comply with them. ANBEL COMMERCE reserves the right to unilaterally update, supplement or modify these General Terms and Conditions as well as the structure of its website. ANBEL COMMERCE is obliged to notify the USER of any amendments to these GENERAL CONDITIONS pursuant to Article 147b of the CPA.
Art. 4. (1) THE USER and ANBEL COMMERCE agree that all statements between them in connection with the conclusion and performance of the purchase and sale contract may be made electronically and through electronic statements within the meaning of the Electronic Document and Electronic Signature Act and Art. 11 of the Electronic Commerce Act.
(2) It is assumed that the electronic statements made by the USERS of the site were made by the persons indicated in the data provided by the USER upon registration, if the USER has entered the relevant username and password for access.
Art. 5. The general terms and conditions for using the E-shop are as follows:
5.1 In order to shop and use all the services of the ANBEL COMMERCE E-Store, it is necessary that the USER is a natural person (18 years or older) or a legal person or other legal entity, has registered voluntarily and free of charge through the registration form. Registration requires the USER to correctly provide his/her data, which includes: first and last name, address, telephone number, e-mail address and password, if necessary the details of a legal entity for the issuance of an invoice.
5.2 ANBEL COMMERCE requires the USER, when purchasing goods and services from the E-shop - https://aestheticalbulgaria.com for another Recipient, to provide the relevant data of the Recipient. ANBEL COMMERCE requires the provision of correct data in order to ensure the quality of the services offered. It is desirable that the USER fills in Cyrillic names and delivery address.
5.3. In the event of incorrect and/or inaccurate data, ANBEL COMMERCE reserves the right to cancel the account created.
5.4. In the e-shop - https://aestheticalbulgaria.com, in accordance with Article 47 of the Consumer Protection Act, each product is indicated: name of the item, brand and model, main characteristics; final price of the product in BGN including VAT.
5.5. ANBEL COMMERCE shall provide, at its discretion, additional consumer information to better inform the USER in making a purchase choice.
5.6. ANBEL COMMERCE reserves the right to change prices without prior notice to users. The USER or the final Recipient shall pay the price valid at the time of order.
5.7. ANBEL COMMERCE shall provide the USER with information about the products according to the characteristics given by the Manufacturer.
Art. 6. USERS, through the Electronic Store, have the opportunity to conclude distance purchase and sale contracts and request delivery of the goods offered by the ELECTRONIC STORE, including the following:
6.1. To register and create a profile for browsing the ELECTRONIC STORE and using the additional services for providing information;
6.2. To make electronic statements in connection with the conclusion or performance of contracts with the ELECTRONIC STORE through the interface of the ELECTRONIC STORE page, accessible on the Internet;
6.3. To conclude contracts for distance purchase and sale and delivery of goods offered by the ELECTRONIC STORE;
6.4. To make any payments in connection with the contracts concluded with the ELECTRONIC STORE, according to the payment methods supported by the ELECTRONIC STORE.
6.5. To receive information about new goods offered by the ELECTRONIC STORE;
6.6. To review the goods, their characteristics, prices and delivery terms;
6.7. To be notified of the rights arising from the law primarily through the interface of the ELECTRONIC STORE page on the Internet;
6.8. To exercise the right to withdraw from the contract concluded at a distance for the goods offered by the Trader, for which the right to withdraw from the contract is applicable;
IV. ORDER OF GOODS AND SERVICES, CONCLUSION OF A CONTRACT
Art. 7. (1) THE USER may purchase goods and services online from https://aestheticalbulgaria.com after logging into your account via the "Login" link with your e-mail address/username and password and filling out the order form with the necessary delivery details: name and surname, address, phone number, e-mail address. You can also shop without registering, as a guest.
(2) The USER selects a specific product by clicking on the «BUY» button available when viewing the product. Clicking this button saves the selected product in a virtual shopping cart.
(3) The USER can view the contents of the basket, add new products or remove already added ones.
(4) The USER confirms his order by pressing the «CLOSE ORDER» button. In the event that he does not add new delivery address details or those of another Recipient, ANBEL COMMERCE defaults to the delivery address indicated in the registration details.
(5) The USER must confirm that he has read the General Terms and Conditions and accepts them, otherwise he cannot complete his order.
(6) When an order is placed, it is registered and the USER receives a message at the e-mail address indicated in the registration with summary data about the order: order number, selected products, unit value, delivery price, total value of the order, delivery address. The message of a registered order with the summary data of the order is not an acceptance or confirmation of its execution. Until the confirmation of the order, which is done by sending an email about the order sent, ANBEL COMMERCE is entitled not to execute the order in full or in part due to reasons beyond its control and subject to these General Terms and Conditions for which it notifies the user by email.
(7) In case of incorrect and/or inaccurate data filled in by the USER or end Recipient, ANBEL COMMERCE will cancel the received order, which automatically terminates the Distance Selling Contract.
(8) The distance sales contract between ANBEL COMMERCE and the USER is considered concluded from the moment of confirmation of the specific order by ANBEL COMMERCE and specification of the delivery term by phone or email for a sent order with an attached invoice, which gives rise to an obligation to pay by the USER for the goods purchased online.
(9) ANBEL COMMERCE reserves the right to cancel an order in the event of a breach of any of these General Terms and Conditions by giving the USER timely notice thereof.
(10) A statement or response to written inquiries and opinions received through the ANBEL COMMERCE contact form is issued to the USER, after verification, within 14 days.
(11) In the event of a complaint filed by the CONSUMER, ANBEL COMMERCE is obliged to bring the goods into compliance with the sales contract within one month from the moment of receipt of the complaint.
(12) In the event of a dispute, you can contact the relevant alternative dispute resolution (ADR) bodies – the conciliation committees of the Consumer Protection Commission at the following address: https://kzp.bg/If a dispute arises related to an online sale, you can use the online dispute resolution (ODR) site
V. PAYMENT METHODS
Art. 8. The USER has the option to choose to pay for the ordered goods through:
- Cash on delivery – cash on delivery
- With a card
Art. 9. All payments shall be made in Bulgarian leva, regardless of the type of payment.
Art. 10. The CONSUMER pays the value of the purchased goods, including the price of delivery.
Art. 11. Through a voluntarily accepted payment method, the USER makes a payment to the MERCHANT for the purchased online goods.
VI. DELIVERY
Delivery of orders
Article 12. Delivery price
The delivery is valid under the following conditions:
The requested products are available.
The goods are received after electronic confirmation of the order, depending on availability.
The delivery address has been specified.
Delivery is made to the entrance of the residential building, without a floor lift service included.
The selected payment method is cash on delivery.
After contact is made by an employee of the respective courier company carrying out the delivery, a change in the delivery address by the USER is requested and arranged according to the general terms and conditions of the respective courier company at the expense of the USER.
Art. 13. Orders shall be delivered to the address indicated by the customer and shall be delivered to the front door of the building, where access is provided either to the boundary of the yard or to the office of a courier company.
Art. 14. Goods ordered through the E-shop https://aestheticalbulgaria.com are delivered by a courier within a period agreed with ANBEL COMMERCE, depending on the availability of the ordered product.
Art. 15. The specified deadlines shall apply in accordance with the announced schedules of the courier companies for remote settlements and official holidays, when deliveries are made by the courier companies.
Art. 16. In the event of delay in delivery, ANBEL COMMERCE shall notify the USER outside the specified period, regardless of the reasons for the delay.
Art. 18. The goods are handed over to the USER/RECIPIENT against a signature, which certifies that ANBEL COMMERCE has fulfilled the order.

Art. 19. THE CONSUMER/RECIPIENT inspects the delivered goods for transport damage or other damages and makes claims in the presence of a courier or person delivering the shipment.
Art. 20. By signing the acceptance and delivery document, the USER authorizes the courier to transfer on his behalf to ANBEL COMMERCE the amount of the total value of the document for the delivered goods, if the cash on delivery payment method is selected.
Art. 21. If the USER cannot be found at the specified delivery address by the courier company, through no fault of ANBEL COMMERCE, the person making the delivery leaves a message with a contact phone number, which the recipient should call within 24 hours to clarify a second delivery attempt.
Art. 22. In the event that the USER does not contact to specify the delivery, the distance selling contract is automatically terminated and ANBEL COMMERCE is released from the obligation to deliver the order.
Art. 23. In the event that the USER refuses to accept the ordered goods, the distance selling contract is automatically terminated and the person making the delivery returns it to ANBEL COMMERCE.
Art. 24. The risk of loss of or damage to the goods shall pass from ANBEL COMMERCE to the USER/CUSTOMER at the moment when he or a person designated by him, other than the carrier, accepts the goods.
VII. Advertising
Art. 25. During receipt of the goods from a courier, the USER / RECEIVER inspects the delivered goods for transport damage or other damage and files claims in the presence of the courier or person delivering the shipment.
Art. 26. In accordance with the Consumer Protection Act, each Customer who has purchased a product from the Online Store https://aestheticalbulgaria.com, has the right to return the product within 14 days from the moment of receipt. It is a mandatory requirement that the product be packaged and assembled in the manner in which it was received and without any damage to the integrity of the product.
Art. 27. When returning the product, it is mandatory to attach the accompanying documents (including if an invoice has been issued).
Art. 28. A product which is not packaged in the manner in which it was received is not returnable and the SELLER shall not be liable for refusal to return the product.
VIII. COMPLAINT AND CANCELLATION OF DISTANCE SALES CONTRACT
Art. 29. Upon receipt of the goods, the USER/RECIPIENT is obliged to immediately inspect them and, in case he finds visible defects such as: broken integrity of the packaging, cosmetic transport defects, lack of accompanying accessories, lack of accompanying documents /any of those required by Bulgarian legislation/, to immediately inform the person carrying out the delivery.
Art. 30. In the event that there are defects or shortcomings in the packaging, in the presence of the courier or the person making the delivery, a report of the findings shall be drawn up, as the USER / RECIPIENT refuses to receive the shipment and informs the trader in writing to the following email address: office@aestheticalbulgaria.com.
Art. 31. In the event that the CONSUMER/RECIPIENT does not inspect the received goods and does not make immediate claims to the person making the delivery, the goods are considered approved, and the consumer loses the right to claim these circumstances at a later stage.
Art. 32. In case the USER has chosen of his own free will a courier company with which ANBEL COMMERCE does not have a contractual relationship for the delivery of his order or has assigned such a company to return the goods back to ANBEL COMMERCE, the risk of loss or damage to the goods is entirely at the expense of the USER in accordance with Art. 103c, para. 2 of the Consumer Protection Act. The USER shall make claims against the carrier chosen by him.
Art. 33. The CONSUMER, who has the capacity of a consumer within the meaning of the Consumer Protection Act, has the right on the basis of Article 50 of the Consumer Protection Act to withdraw from the concluded distance contract without penalty or compensation within 14 days from the date of receipt of the goods, in accordance with Article 50 paragraph 2a,b .
Art. 34. The CONSUMER shall inform ANBEL COMMERCE in writing of his decision to withdraw from the sales contract before the expiry of the 14-day period referred to in Article 50 of the Consumer Protection Act, ANBEL COMMERCE shall send the CONSUMER an immediate confirmation of receipt of the application for withdrawal from the sales contract.
Art. 35. The USER returns the goods to ANBEL COMMERCE within 14 days of submitting the claim and pays the transport costs for returning the goods only and only if the goods are in an undamaged commercial condition. The deadline for returning the goods back to ANBEL COMMERCE is before the expiry of the 14-day period to the shipping address.
Art. 36. The right of withdrawal from a distance sales contract within 14 days under Article 50 of the Consumer Protection Act shall not apply to unpacked goods and consumables, which by their nature may deteriorate in quality. In accordance with Article 57(9) of the CPA, ANBEL COMMERCE shall not refund any amount paid for an information product used or tested in order to ascertain its nature, characteristics and proper functioning.
