General terms and conditions

I. SUBJECT

Чл. 1. Настоящите Oбщи условия са предназначени за регулиране на отношенията между „АНБЕЛ КОММЕРС“ ЕООД, гр. София, наричано по-долу за краткост АНБЕЛ КОММЕРС и клиентите, които ползват „ЕЛЕКТРОННИЯ МАГАЗИН” и/или искат да се сключи договор от разстояние, наричани по-долу ПОТРЕБИТЕЛИ, на електронния магазин, намиращ се на електронен адрес https://aestheticalbulgaria.com и електронна поща office@aestheticalbulgaria.com, наричан по-долу „ЕЛЕКТРОНЕН МАГАЗИН”. Този документ по-конкретно урежда взаимоотношенията във връзка с процедурата по сключване, изменение и прекратяване на договори по реда и при условията на  Глава IV, раздел I „Договор извън търговски обект и договор от разстояние” от ЗЗП посредством „ЕЛЕКТРОНЕН МАГАЗИН” на АНБЕЛ КОММЕРС, както и условията за ползване на „ЕЛЕКТРОНЕН МАГАЗИН” на АНБЕЛ КОММЕРС.

III. GENERAL TERMS AND CONDITIONS AND CHARACTERISTICS OF THE ELECTRONIC STORE

Чл. 3. С цел избягване на всякакво съмнение, Електронният магазин АНБЕЛ КОММЕРС, намиращ се на електронен адрес https://aestheticalbulgaria.com се администрира от „АНБЕЛ КОММЕРС“ ЕООД.

The e-store https://aestheticalbulgaria.com serves as a virtual platform for offering and selling goods and services.

ПОТРЕБИТЕЛЯТ се съгласява с настоящите общи условия на АНБЕЛ КОММЕРС, като ги приема безусловно и поема задължението да ги спазва. АНБЕЛ КОММЕРС си запазва правото едностранно да  обновява, допълва или променя настоящите Общи условия, както и структурата на своята Интернет страница. АНБЕЛ КОММЕРС е длъжен да уведоми ПОТРЕБИТЕЛЯТ за изменения в настоящите ОБЩИ УСЛОВИЯ според чл. 147б от ЗЗП.

Art. 4. (1) THE USER and ANBEL COMMERCE agree that all statements between them in connection with the conclusion and performance of the purchase and sale contract may be made electronically and through electronic statements within the meaning of the Electronic Document and Electronic Signature Act and Art. 11 of the Electronic Commerce Act.

(2) It is assumed that the electronic statements made by the USERS of the site were made by the persons indicated in the data provided by the USER upon registration, if the USER has entered the relevant username and password for access.

Art. 5. The general terms and conditions for using the E-shop are as follows:

5.1 За да пазарува и ползва всички услуги на Електронния магазина на АНБЕЛ КОММЕРС, е необходимо ПОТРЕБИТЕЛЯТ да е физическо лице (на или над 18г.) или юридическо лице или друго правно образувание, да се е регистрирал доброволно и безплатно чрез регистрационната форма. Регистрацията изисква ПОТРЕБИТЕЛЯТ да предостави коректно своите данни, които включват: име и фамилия, адрес, телефон, е-mail адрес и парола, при необходимост данни на юридическо лице за издаване на фактура. 

5.2 АНБЕЛ КОММЕРС изисква от ПОТРЕБИТЕЛЯ, когато закупува стоки и услуги от Електронния магазин – https://aestheticalbulgaria.com за друг Получател, ПОТРЕБИТЕЛЯ да предостави съответните данни на Получателя. АНБЕЛ КОММЕРС изисква предоставянето на коректни данни с цел качествено изпълнение на предлаганите услуги. Желателно е ПОТРЕБИТЕЛЯТ да попълва на кирилица имената и адрес за доставка.

5.3. При некоректно и/или неточно посочени данни АНБЕЛ КОММЕРС си запазва правото да анулира създаденият профил.

5.4. В Електронния магазин – https://aestheticalbulgaria.com, съгласно чл.47 от ЗЗП, на всеки продукт са посочени: наименование на артикул, марка и модел, основни характеристики; крайна цена на продукта в лева с включен ДДС.

5.5.  АНБЕЛ КОММЕРС предоставя по своя преценка допълнителна потребителска информация, за по-пълна информираност на ПОТРЕБИТЕЛЯ при избора на покупка.

5.6. АНБЕЛ КОММЕРС запазва правото си да променя цените без да уведомява предварително потребителите. ПОТРЕБИТЕЛЯТ или крайния Получател заплаща цената, валидна в момента на поръчката.

5.7.  АНБЕЛ КОММЕРС предоставя на ПОТРЕБИТЕЛЯ информация за продуктите съгласно характеристиките дадени от Производителя.

Art. 6. USERS, through the Electronic Store, have the opportunity to conclude distance purchase and sale contracts and request delivery of the goods offered by the ELECTRONIC STORE, including the following:

6.1. To register and create a profile for browsing the ELECTRONIC STORE and using the additional services for providing information;

6.2. To make electronic statements in connection with the conclusion or performance of contracts with the ELECTRONIC STORE through the interface of the ELECTRONIC STORE page, accessible on the Internet;

6.3. To conclude contracts for distance purchase and sale and delivery of goods offered by the ELECTRONIC STORE;

6.4. To make any payments in connection with the contracts concluded with the ELECTRONIC STORE, according to the payment methods supported by the ELECTRONIC STORE.

6.5. To receive information about new goods offered by the ELECTRONIC STORE;

6.6. To review the goods, their characteristics, prices and delivery terms;

6.7. To be notified of the rights arising from the law primarily through the interface of the ELECTRONIC STORE page on the Internet;

6.8. To exercise the right to withdraw from the contract concluded at a distance for the goods offered by the Trader, for which the right to withdraw from the contract is applicable;

IV. ORDER OF GOODS AND SERVICES, CONCLUSION OF A CONTRACT

Art. 7. (1) THE USER may purchase goods and services online from https://aestheticalbulgaria.com after logging into your account via the "Login" link with your e-mail address/username and password and filling out the order form with the necessary delivery details: name and surname, address, phone number, e-mail address. You can also shop without registering, as a guest.

(2) ПОТРЕБИТЕЛЯТ  избира конкретен продукт чрез кликване върху бутона «КУПЕТЕ» достъпен при преглед на продукта. Натискането на този бутон записва избрания продукт във виртуална потребителска кошница.

(3) ПОТРЕБИТЕЛЯТ може да разглежда съдържанието на кошницата, да добавя нови продукти или да премахне вече добавени.

(4) ПОТРЕБИТЕЛЯТ потвърждава поръчката си чрез натискане на бутона «ПРИКЛЮЧВАНЕ НА ПОРЪЧКАТА». В случай, че не добави нови данни за адрес на доставка или на друг Получател, АНБЕЛ КОММЕРС приема по подразбиране  адреса за доставка, посочен в данните при регистрацията.

(5) ПОТРЕБИТЕЛЯТ задължително потвърждава, че се е запознал с Общите условия и ги приема, в противен случай не може да завърши своята поръчка.

(6) При направена поръчка, същата се регистрира и ПОТРЕБИТЕЛЯТ получава съобщение на посочения от него в регистрацията e-mail адрес с обобщени данни за направената поръчка: номер на поръчка, избрани продукти, единична стойност, цена за доставка, обща стойност на поръчката, адрес за доставка. Съобщението за регистрирана поръчка с обобщените данни за нея, не е приемане или потвърждение за изпълнението ѝ. До потвърждението на поръчката, което става  с изпращане на имейл за изпратената поръчка, АНБЕЛ КОММЕРС е в правото си да не изпълни изцяло или частично поръчката поради наличие на независещи от него причини и при настоящите общи условия за което уведомява ползвателя с имейл.

(7) In case of incorrect and/or inaccurate data filled in by the USER or end Recipient, ANBEL COMMERCE will cancel the received order, which automatically terminates the Distance Selling Contract.

(8) The distance sales contract between ANBEL COMMERCE and the USER is considered concluded from the moment of confirmation of the specific order by ANBEL COMMERCE and specification of the delivery term by phone or email for a sent order with an attached invoice, which gives rise to an obligation to pay by the USER for the goods purchased online.

(9) АНБЕЛ КОММЕРС си запазва правото  да отмени поръчка при нарушение на някое от настоящите общи условия, като за това уведоми своевременно ПОТРЕБИТЕЛЯТ.

(10) A statement or response to written inquiries and opinions received through the ANBEL COMMERCE contact form is issued to the USER, after verification, within 14 days.

(11) In the event of a complaint filed by the CONSUMER, ANBEL COMMERCE is obliged to bring the goods into compliance with the sales contract within one month from the moment of receipt of the complaint.

(12) In the event of a dispute, you can contact the relevant alternative dispute resolution (ADR) bodies – the conciliation committees of the Consumer Protection Commission at the following address: https://kzp.bg/If a dispute arises related to an online sale, you can use the online dispute resolution (ODR) site

V. PAYMENT METHODS

Art. 8. The USER has the option to choose to pay for the ordered goods through:

• Cash on delivery – cash on delivery 
• With a card 

Art. 9. All payments shall be made in Bulgarian leva, regardless of the type of payment.

Art. 10. The CONSUMER pays the value of the purchased goods, including the price of delivery.

Art. 11. Through a voluntarily accepted payment method, the USER makes a payment to the MERCHANT for the purchased online goods. 

VI. DELIVERY

Delivery of orders

Article 12. Delivery price

The delivery is valid under the following conditions:

The requested products are available.

The goods are received after electronic confirmation of the order, depending on availability.

The delivery address has been specified.

Delivery is made to the entrance of the residential building, without a floor lift service included.

The selected payment method is cash on delivery.

After contact is made by an employee of the respective courier company carrying out the delivery, a change in the delivery address by the USER is requested and arranged according to the general terms and conditions of the respective courier company at the expense of the USER.

Чл. 13. Поръчките се доставят до адрес посочен от клиента като се извършва до входната врата на сградата, при осигурен достъп или до границата на дворното място или до офис на куриерска фирма.

Art. 14. Goods ordered through the E-shop https://aestheticalbulgaria.com are delivered by a courier within a period agreed with ANBEL COMMERCE, depending on the availability of the ordered product.

Art. 15. The specified deadlines shall apply in accordance with the announced schedules of the courier companies for remote settlements and official holidays, when deliveries are made by the courier companies.

Чл. 16. В случай на забавяне на доставката, АНБЕЛ КОММЕРС извън посочения срок е длъжен да уведоми ПОТРЕБИТЕЛЯ, независимо от причините на забавянето.

Art. 18. The goods are handed over to the USER/RECIPIENT against a signature, which certifies that ANBEL COMMERCE has fulfilled the order.

Чл. 18. Стоката се предава на ПОТРЕБИТЕЛЯТ/ПОЛУЧАТЕЛЯ срещу подпис, с който се удостоверява, че АНБЕЛ КОММЕРС е изпълнил поръчката.

Art. 19. THE CONSUMER/RECIPIENT inspects the delivered goods for transport damage or other damages and makes claims in the presence of a courier or person delivering the shipment.

Art. 20. By signing the acceptance and delivery document, the USER authorizes the courier to transfer on his behalf to ANBEL COMMERCE the amount of the total value of the document for the delivered goods, if the cash on delivery payment method is selected.

Art. 21. If the USER cannot be found at the specified delivery address by the courier company, through no fault of ANBEL COMMERCE, the person making the delivery leaves a message with a contact phone number, which the recipient should call within 24 hours to clarify a second delivery attempt.

Art. 22. In the event that the USER does not contact to specify the delivery, the distance selling contract is automatically terminated and ANBEL COMMERCE is released from the obligation to deliver the order.

Art. 23. In the event that the USER refuses to accept the ordered goods, the distance selling contract is automatically terminated and the person making the delivery returns it to ANBEL COMMERCE.

Чл. 24. Рискът от загуба или повреда на стоката преминава от АНБЕЛ КОММЕРС върху ПОТРЕБИТЕЛЯТ/ПОЛУЧАТЕЛЯТ в момента, в който той  или посочено от него лице, различно от превозвача, приеме стоката.

VII. Рекламация

Art. 25. During receipt of the goods from a courier, the USER / RECEIVER inspects the delivered goods for transport damage or other damage and files claims in the presence of the courier or person delivering the shipment.

Art. 26. In accordance with the Consumer Protection Act, each Customer who has purchased a product from the Online Store https://aestheticalbulgaria.com, has the right to return the product within 14 days from the moment of receipt. It is a mandatory requirement that the product be packaged and assembled in the manner in which it was received and without any damage to the integrity of the product.

Art. 27. When returning the product, it is mandatory to attach the accompanying documents (including if an invoice has been issued). 

Чл. 28.  Продукт, който не е опакован по начина, по който е получен, не подлежи на връщане и ПРОДАВАЧЪТ не носи отговорност за отказа за връщане на продукта.

VIII. РЕКЛАМАЦИЯ И ОТКАЗ ОТ ДОГОВОР ЗА ПРОДАЖБА ОТ РАЗСТОЯНИЕ

Art. 29. Upon receipt of the goods, the USER/RECIPIENT is obliged to immediately inspect them and, in case he finds visible defects such as: broken integrity of the packaging, cosmetic transport defects, lack of accompanying accessories, lack of accompanying documents /any of those required by Bulgarian legislation/, to immediately inform the person carrying out the delivery.

Чл. 30. В случай, че са налични дефекти или установени липси в окомплектовката, в присъствие на куриера или лицето извършващо доставката, се съставя констативен протокол като ПОТРЕБИТЕЛЯТ/ПОЛУЧАТЕЛЯТ отказва да получи пратката и информира търговеца в писмен вид на следният имейл адрес: office@aestheticalbulgaria.com.

Art. 31. In the event that the CONSUMER/RECIPIENT does not inspect the received goods and does not make immediate claims to the person making the delivery, the goods are considered approved, and the consumer loses the right to claim these circumstances at a later stage.

Art. 32. In case the USER has chosen of his own free will a courier company with which ANBEL COMMERCE does not have a contractual relationship for the delivery of his order or has assigned such a company to return the goods back to ANBEL COMMERCE, the risk of loss or damage to the goods is entirely at the expense of the USER in accordance with Art. 103c, para. 2 of the Consumer Protection Act. The USER shall make claims against the carrier chosen by him.

Чл. 33. ПОТРЕБИТЕЛЯТ, който има качество на потребител по смисъла на ЗЗП, има право на основание чл.50 от ЗЗП да се откаже от сключения договор от разстояние без да дължи неустойка или обезщетение в срок от 14 дни, считано от датата на получаване на стоката, съгласно чл.50 т.2а,б .

Чл. 34. ПОТРЕБИТЕЛЯТ информира писмено АНБЕЛ КОММЕРС за решението си да се откаже от договора за продажба преди изтичането на 14-дневния срок по чл.50 от ЗЗП, АНБЕЛ КОММЕРС изпраща на ПОТРЕБИТЕЛЯ незабавно потвърждение на получено заявление за отказ от договор за продажба.

Art. 35. The USER returns the goods to ANBEL COMMERCE within 14 days of submitting the claim and pays the transport costs for returning the goods only and only if the goods are in an undamaged commercial condition. The deadline for returning the goods back to ANBEL COMMERCE is before the expiry of the 14-day period to the shipping address.

Чл. 36. Правото на отказ от договор за продажба от разстояние в 14-дневен срок по чл.50 от ЗЗП не се прилага за разопаковани стоки и консумативи, които поради своето естество могат да влошат качеството си. Във връзка с чл.57 т.9 от ЗЗП, АНБЕЛ КОММЕРС не възстановява заплатена сума за използван или изпробван информационен продукт, с цел да се установи естеството, характеристиките и доброто функциониране.
